These Terms of Service (“Terms“) govern your access to and use of spiritgunworks.com and shop.spiritgunworks.com (the “Sites”), operated by Spirit Gun Works (“SGW,” “we,” “us,” “our”). By using the Sites or placing an order you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Sites.
1. Eligibility
To use the Sites and purchase products you must be at least eighteen (18) years old, or twenty-one (21) where required by state or federal law for the specific product. You must be legally permitted to own and possess firearms and ammunition under federal, state, and local law. You may not use the Sites if you are a “prohibited person” under 18 U.S.C. §922(g), including but not limited to convicted felons, persons subject to certain protective orders, and unlawful users of controlled substances.
2. Your Account
If you create an account, you are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use. You must provide accurate, current, and complete information.
3. Products, Pricing, and Availability
We work to keep product listings accurate but we do not warrant that descriptions, images, pricing, or availability are error-free. We reserve the right to correct errors, change prices at any time, refuse or cancel orders (including after order confirmation), and limit quantities. If we cancel a paid order due to an error, we will issue a full refund promptly.
4. Orders and Payment
Placing an order constitutes an offer to buy. We may accept or decline any order. Charges are processed through our third-party payment provider. You represent that you are authorized to use the payment method you provide. Applicable taxes will be added at checkout based on ship-to jurisdiction.
5. Firearm Purchases
Firearm sales are governed by federal, state, and local law and by our FFL Transfer Policy. You acknowledge:
- Firearms cannot be shipped directly to you; they must be transferred through a Federal Firearms Licensed dealer that you select at checkout.
- You must complete an ATF Form 4473 and pass a background check (NICS) at the receiving FFL before taking possession.
- You are solely responsible for compliance with laws in your city, county, and state, including waiting periods, permit requirements, magazine capacity limits, and roster restrictions.
- If your background check is denied, or you cannot legally complete the transfer, the firearm is subject to our Refund & Return Policy.
6. Shipping and Delivery
Please review our Shipping Policy for processing times, carriers, restricted states, and adult signature requirements. Risk of loss transfers to you when the carrier delivers the product to the destination address (which, for firearms, will be your chosen FFL).
7. Cancellations, Refunds, and Returns
All cancellations, refunds, and returns are governed by our Refund & Return Policy. Please read it carefully — certain items (including any firearm you have taken possession of, and ammunition) are non-returnable.
8. Prohibited Uses
You agree not to:
- Use the Sites for any unlawful purpose or in violation of any applicable law
- Attempt to purchase products for someone else in a straw purchase
- Resell products purchased from us without complying with applicable licensing law
- Interfere with or disrupt the Sites, security, or their normal operation
- Copy, scrape, or otherwise misappropriate content or product data from the Sites
- Impersonate any person or misrepresent your affiliation
9. Intellectual Property
The Sites and all content on them — including the SGW name, logo, text, images, and product photography — are owned by SGW or its licensors and are protected by copyright, trademark, and other laws. You may not use any of it commercially without our prior written permission.
10. Third-Party Links
The Sites may link to third-party websites (payment processors, FFL search tools, government resources). We are not responsible for the content, policies, or practices of those sites.
11. Disclaimers
The Sites and all products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, except those warranties that cannot be lawfully disclaimed. Manufacturers’ warranties on individual products apply according to their own terms.
12. Limitation of Liability
To the maximum extent permitted by law, SGW and its owners, employees, and contractors will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, arising out of or related to your use of the Sites or any product purchased through them, even if we have been advised of the possibility. Our total liability for any claim arising from your use of the Sites or a product will not exceed the amount you paid for the product giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless SGW and its owners, employees, and contractors from any claim, demand, loss, or damages (including reasonable attorneys’ fees) arising out of your use of the Sites, your breach of these Terms, or your violation of any law.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute must be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction there.
15. Modifications
We may update these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Sites after changes take effect means you accept the revised Terms.
